If a separate written agreement applies, that agreement controls to the extent it conflicts with these Terms.
4. Business and government audience
Thebe Space provides business-to-business and business-to-government information, products, and services.
The websites are not directed to children or to general consumer audiences.
The websites may describe products, services, materials, or capabilities that are available only to eligible organisations, authorised users, or customers under separate agreements.
5. Website content
The websites may include text, graphics, images, diagrams, videos, documents, product descriptions, technical descriptions, marketing materials, articles, announcements, forms, downloads, and other public content.
Website content is provided for general information only.
Website content does not create a binding offer, commitment, representation, warranty, procurement response, technical specification, service level, security commitment, compliance commitment, or contractual obligation unless expressly stated in a separate written agreement signed by Thebe Space LLC.

6. No reliance on website content

Any purchase, licence, subscription, pilot, evaluation, implementation, or use of Thebe Space products or services should be governed by the applicable written agreement, order, end user licence agreement, statement of work, procurement document, or other applicable terms.
7. Intellectual property
The websites and website content, including text, graphics, logos, designs, interfaces, documentation, diagrams, workflows, data structures, models, names, marks, and other materials, are owned by Thebe Space LLC or licensed to Thebe Space LLC by affiliates, licensors, suppliers, or other rights holders.
Except as expressly allowed by these Terms or a separate written agreement, you may not copy, modify, distribute, sell, lease, sublicense, publicly display, create derivative works from, or otherwise exploit any part of the websites or website content.
No ownership rights are transferred to you under these Terms.

Thebe Space applications, installed software, restricted services, customer systems, subscriptions, pilots, evaluations, production services, and other non-public offerings may be subject to a separate end user licence agreement, customer agreement, order, statement of work, procurement document, or other written agreement.
These Terms do not grant any licence to install or use Thebe Space software or applications.
If a separate written agreement applies, that agreement controls to the extent it conflicts with these Terms.
16. Website availability and changes
We may add, modify, suspend, discontinue, update, or remove websites, website content, features, forms, downloads, or functionality at any time.
The websites may be unavailable due to maintenance, updates, security work, outages, third-party issues, network issues, force majeure events, or other operational reasons.
We do not guarantee that the websites will be uninterrupted, error-free, vulnerability-free, or available at all times.
17. Disclaimers
To the maximum extent permitted by law, the websites and website content are provided “as is” and “as available.”
Thebe Space LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted operation.

To the maximum extent permitted by law, Thebe Space LLC’s total liability arising out of or relating to the websites, website content, or these Terms will not exceed one hundred United States dollars.
This limitation does not apply where liability cannot be limited under applicable law or where a separate written agreement provides otherwise.

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Thebe Space LLC and its affiliates, licensors, suppliers, officers, directors, employees, contractors, and agents from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to:

- your breach of these Terms;
- your violation of law, regulation, contract, or third-party rights;
- information, materials, or communications you submit through the websites;
- unauthorised access or use caused by your conduct;
- your use of restricted information or materials outside the scope of your authorisation.

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules.
Subject to any separate written agreement, government contract, procurement term, platform term, or applicable mandatory law, the state and federal courts located in Colorado will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the websites.
You and Thebe Space LLC consent to the jurisdiction and venue of those courts.
22. Changes to these Terms
We may update these Terms from time to time.
The latest version will be posted on the relevant website with the effective date.
Your continued access to or use of the websites after updated Terms become effective means you accept the updated Terms.
If you do not agree to updated Terms, you must stop using the websites.
